Please read the following terms and conditions carefully before placing an order or engaging our services. By purchasing products or services from Foothills Custom Outdoors, you acknowledge that you have read, understood, and agree to be bound by these terms.
1. General
These terms and conditions (“Terms”) govern your purchase of products and services from Foothills Custom Outdoors (“we,” “us,” “our,” or “Company”), a business operated in Knoxville, Tennessee. These Terms apply to all orders placed through our website, by phone, by email, or in person.
We reserve the right to update or modify these Terms at any time. The most current version will always be available on our website. Your continued use of our services or website after any changes constitutes acceptance of the updated Terms.
2. Products and Services
Foothills Custom Outdoors sells outdoor structures, furniture, grills, and related products. We also provide professional installation services for applicable products within our service area in East Tennessee.
Product descriptions, images, and specifications on our website are provided for informational purposes and are as accurate as possible. However, slight variations in color, dimensions, or features may occur due to manufacturing processes, screen display differences, or product updates by the manufacturer.
We reserve the right to limit quantities, discontinue products, or modify product offerings at any time without prior notice.
3. Orders and Pricing
All orders are subject to acceptance by Foothills Custom Outdoors. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraudulent activity.
Prices are subject to change without notice. The price in effect at the time your order is confirmed is the price that will apply to your purchase. Applicable sales tax will be added to your order total in accordance with Tennessee state and local tax requirements.
4. Payment
Payment is due at the time of purchase unless otherwise agreed upon in writing. We accept major credit cards, debit cards, cash, checks, and approved financing arrangements.
If payment is not received in full prior to installation, we reserve the right to delay or cancel the scheduled installation until payment is resolved.
5. Shipping, Delivery, and Installation
Please refer to our Shipping and Delivery Policy for detailed information regarding delivery timelines, local delivery, carrier shipments, and installation scheduling.
For products delivered by carrier (not installed by our team), you are responsible for inspecting the shipment upon receipt. If damage or missing items are identified, you must notify us within 48 hours of delivery.
For products installed by Foothills Custom Outdoors, our team will transport, unload, assemble, and install the structure at your property. You are responsible for ensuring adequate site access and a reasonably prepared installation area as discussed during your consultation.
6. Cancellations
If you cancel your order prior to shipment or installation scheduling, we will cancel the transaction and no fees will apply.
If you cancel after an order has shipped, you must refuse the shipment upon delivery. Applicable return and restocking fees will apply per our Returns and Refund Policy.
If you cancel after installation has been scheduled and materials have been ordered or delivered to your property, a cancellation fee may apply to cover costs already incurred.

9. Site Access and Property Conditions
For installation projects, you are responsible for:
- Providing accurate information about your property during the consultation process, including but not limited to terrain conditions, utility locations, HOA requirements, and permit status.
- Ensuring clear and adequate access to the installation site for our team and equipment.
- Obtaining any required building permits, HOA approvals, or other authorizations prior to installation, unless we have specifically agreed to handle this as part of your project scope.
- Disclosing the location of underground utilities (water, gas, electric, septic, cable) to prevent damage during site preparation.
Foothills Custom Outdoors is not liable for damage to underground utilities, landscaping, or other property features that were not disclosed or accurately identified prior to installation.
10. Limitation of Liability
To the fullest extent permitted by law, Foothills Custom Outdoors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase, use, or inability to use any product or service, even if we have been advised of the possibility of such damages.
Our total liability for any claim related to a product or service shall not exceed the amount you paid for that specific product or service.
We are not responsible for any injury, damage, or loss that occurs during self assembly or self installation of any product.
11. Force Majeure
Foothills Custom Outdoors shall not be liable for delays or failure to perform resulting from causes beyond our reasonable control, including but not limited to: severe weather, natural disasters, acts of God, pandemics, supply chain disruptions, manufacturer delays, labor shortages, government actions, or utility failures.
12. Intellectual Property
All content on the Foothills Custom Outdoors website, including text, images, graphics, logos, and design elements, is the property of Foothills Custom Outdoors or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles. Any dispute arising from or related to these Terms or your purchase shall be resolved in the courts of Knox County, Tennessee.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.
15. Entire Agreement
These Terms, together with our Shipping and Delivery Policy, Returns and Refund Policy, Warranty Information, Privacy Policy, and any project specific agreements, constitute the entire agreement between you and Foothills Custom Outdoors regarding your purchase and supersede all prior agreements, communications, and understandings.
